Client Alert | LIE Definitive Suspension

Definitive suspensions are granted against the Decree by which provisions of the Electric Industry Law are modified and amended.

On March 9, 2021, the decree that amends and adds various provisions to the Electric Industry Law (the “Decree”) was published in the Official Gazette of the Federation. This Decree entered into force on March 10, 2021.

On March 10, 2021, multiple amparo lawsuits were filed against the Decree.

On March 11, 2021, the Second District Judge in administrative matters specialized in economic competition, broadcasting, and telecommunications, admitted the demands and granted the first provisional suspensions with general effects.

On March 19, 2021, the Second District Judge granted three definitive suspensions with general effects.

General effects were given to the suspension to avoid distortions in the electric sector regarding the impact that this could bring, not only for the complainants, but mainly for the end users and the population in general. The responsible authorities will have a period of 10 days to challenge this suspension via an appeal for review which will be resolved by the collegiate courts specialized in economic competition.
