GC Alert | Mexican Supreme Court approves ruling against the Electric Industry Law with general effects.

Gonzalez Calvillo, Febrero 2024 – Following our September 2023 alert (visit here),  on January 31, 2024, the Second Section of the Suprema Corte de Justicia de la Nación (“SCJ“), approved a draft ruling of an amparo appeal  issued by Justice Alberto Pérez Dayán, which declared the unconstitutionality of certain provisions of the amendments to the Ley de la Industria Eléctrica (“Electric Industry Law” or “LIE“), published in the Diario Oficial de la Federación (“Official Gazette”) on March 9th, 2021 (“Decree“). The above declaration has general effects.

The amparo was granted by a vote of 2 Justices in favor (with Justice Perez Dayan having the tie-breaking vote as Chairman of the Second Section of the SCJN) and 2 Justices against (Justice Laynez abstained from voting).
